Do I need to obtain permission to build a bathhouse in 2021?

Formally, there is no need to obtain a permit to build a bathhouse on your own site, provided that it will not be used for commercial purposes, paragraphs. 3 paragraph 17 art. 51 Civil Code of the Russian Federation.

According to Part 17 of Art. 51 of the Town Planning Code of the Russian Federation, there is a list of real estate objects for the construction of which it is not necessary to obtain permits. This list includes the following types of buildings:

  • garages and buildings of economic importance that were built for personal needs and do not imply profit for the owner;
  • trade kiosks and buildings not included in the list of capital structures;
  • other buildings that do not contradict established standards.

According to the list, the bathhouse, which is planned to be built on a suburban plot of land, is not a commercial property. Therefore, as a rule, a permit is not required for its construction.

Extension to the house

If the bathhouse is an extension to a residential building and is not an independent structure, then it is subject to mandatory legal registration and for its construction it is necessary to obtain permission from the local administration.

According to Letter of the Ministry of Economic Development of the Russian Federation No. 32363-VA/D23i dated November 7, 2020, there is no need to coordinate the construction of a bathhouse on a summer cottage with anyone. It does not matter what kind of building will be erected - on a foundation or on stilts.

Thus, it is necessary to obtain a construction permit and then carry out the registration procedure for a free-standing bathhouse if at least one of the conditions is met:

  • the building has 2 or 3 floors;
  • the bathhouse is being built without a residential building on the site;
  • the building has at least one residential or technical space, such as a recreation room, bedroom, kitchen, bathroom, etc.;

In all other cases, when the bathhouse is not intended for housing and is not a commercial building, it is enough to prepare a technical plan and submit it to the Rosreestr authority. Such real estate objects are recognized as improvements to the local area and are the private property of the owner of the site.

Thus, if the building planned for construction involves more than one floor, will be large in size, or will be an extension to a residential building, you must obtain permission to build a bathhouse in 2021 from the administration of the locality.

To install, dismantle or move any other auxiliary building, consent from the administration is not required.

Do I need to receive it?

In accordance with Part 6 of Art. 1 Federal Law No. 218 of July 13, 2019 “On state registration of real estate” and Art. 130 of the Civil Code of the Russian Federation, bathhouses with a foundation belong to the category of capital buildings and require registration. A compact, lightweight building with a non-buried foundation does not require permission .
At the same time, communications should not be connected to it. A bathhouse without a permanent foundation can be installed on a SNT, individual housing construction or private plot plot. A permit will be required if the building has a permanent foundation and communications are connected to it - water supply, sewerage, electricity.

Procedure for registering a constructed facility

What difficulties arise during registration?
